Temporary Moratorium on Residential and Commercial Evictions in Marin County

On March 24, 2020, the Marin County Board of Supervisors unanimously voted to adopt a resolution issuing a temporary moratorium on residential and commercial evictions for non-payment of rent due to direct impacts of the COVID-19 crisis. This temporary moratorium applies to all cities, towns and unincorporated areas within Marin County and is currently scheduled to be in place until May 31, 2020.

On March 3, Marin Health and Human Services issued a local health emergency proclamation as a first step in preparing for impacts associated with COVID-19. As this situation continues to evolve, Marin County has determined that a countywide approach to promote housing security and commercial stability are necessary to protect public health, mitigate the economic impacts and to accomplish the public health goals of limiting the spread of COVID-19. This temporary moratorium applies to all residential and commercial tenants within Novato city limits, as well as unincorporated Novato that are directly impacted by the COVID-19 crisis, including those suffering from a substantial loss of income due to:

  • Business closure
  • Loss of work or wages
  • Layoffs
  • Missed work or childcare expenditures due to school closure
  • Medical Expenses related to being ill with COVID-19 or caring for a member of the household ill with COVID-19
  • Other similarly-caused reason resulting in a loss of income due to COVID-19

Under provisions of the resolution, tenants must provide notice to their landlord, or their landlords designee, within 30 days after the date that rent was due that they are unable to pay due to financial impacts of COVID-19.  Within one week of providing notice, tenants are required to provide documentation or other objectively verifiable information of these financial impacts. 

This resolution does not relieve the residential or commercial tenant of the liability for the unpaid rent, and the landlord may seek payment after the expiration of the local emergency.
